You may use Qubi 360 for your business as long as you pay for it, do not break the law with it, and do not try to break it. We will keep it running, keep your data yours, and give you notice before anything material changes.
This summary is for orientation. The sections below are the terms that apply.The agreement
These terms form an agreement between you (the customer, meaning the organisation that opened the account) and Qubalytic (we, us) covering your use of Qubi 360 and any related services.
By opening an account, starting a trial, or using the service, you accept these terms. If you are accepting on behalf of an organisation, you confirm you have the authority to do so.
Your account
You are responsible for the accuracy of the information you give us, for keeping credentials secure, and for what the users in your account do.
Your administrator controls who has access and what each role can reach. We will act on instructions from an administrator without separately verifying them with your other users.
You must tell us promptly if you believe an account has been compromised.
Acceptable use
You may not use the service to store or transmit unlawful material, infringe anyone’s rights, send unsolicited bulk messaging, attempt to gain unauthorised access, interfere with the service, or reverse engineer it.
Where the service sends messages on your behalf — email or SMS — you are responsible for having a lawful basis to contact those recipients and for honouring opt-outs.
Fees and billing
Subscription fees are charged per user on the plan and cycle you select. Monthly plans renew monthly; annual plans renew annually.
Prices exclude taxes unless stated otherwise. Where tax applies, it is added at the prevailing rate for your place of supply.
If you add users mid-cycle, the additional charge is prorated. If you remove users, the reduction applies from the next cycle.
We may change prices with at least thirty days’ notice before your next renewal. If you do not accept a change, you may cancel before it takes effect.
Term, renewal and cancellation
Subscriptions renew automatically unless cancelled before the renewal date. You can cancel at any time from your account settings.
Cancellation stops the next renewal. It does not, by itself, refund the current period; refunds are covered in our refund policy.
We may suspend or terminate an account for non-payment, for a material breach of these terms, or where continued use would expose us or others to legal risk. Except where the law or the seriousness of the breach requires immediate action, we will give notice and a reasonable opportunity to fix the problem first.
Your data
Your data remains yours. We process it to provide the service, and for no other purpose. We do not sell it and we do not use it to train models.
You can export your data at any time while the account is active. After termination we retain it for a limited window so you can retrieve it, then delete it. The current window is set out in the privacy policy.
You are responsible for having the right to hold the personal data you put into the service, including data about your own employees and customers.
Availability and support
We aim for high availability and publish an uptime commitment. Enterprise agreements may carry a specific service level with agreed remedies.
Planned maintenance is announced in advance where practical, and scheduled to minimise disruption. Emergency maintenance may occur without notice.
Support channels and response targets depend on your plan.
Intellectual property
We own the service, its software and its documentation. You receive a non-exclusive, non-transferable right to use it during your subscription.
You own your data and your content. You grant us only the rights needed to host, process, transmit and back it up in order to run the service for you.
If you send us feedback or suggestions, we may use them without obligation to you.
Liability
The service is provided as described in our documentation. To the extent permitted by law, we exclude implied warranties.
Neither party is liable for indirect or consequential loss. Our aggregate liability in any twelve-month period is limited to the fees you paid in that period.
Nothing in these terms limits liability that cannot be limited by law.
Changes to these terms
We may update these terms. For material changes we will give notice by email or in the product before they take effect, and the date at the top of this page will change.
Continuing to use the service after a change takes effect means you accept the updated terms.
Governing law
These terms are governed by the laws of India, and the courts of Jaipur, Rajasthan have exclusive jurisdiction, unless a separate signed agreement says otherwise.
